I acknowledge that this is an Accident Waiver and Release of Liability Form and will be used by ShapeShifts Coaching (SSC) LLC and its instructors, event holders, sponsors, and organizers of any activity in which I may participate, and that it will govern my actions and responsibilities at said activity.

I acknowledge SSC LLC and their directors, officers, instructors, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. SSC LLC is also not responsible if any participant tries a class, private lesson or event activity afterward on the premises or on other property.

I acknowledge that attending classes, taking private lessons and participating in studio activities may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. These risks are not only inherent to participants, but are also present for volunteers and SSC employees/owners.

I certify that there are no health-related reasons that preclude my participation in this class or activity.

I hereby assume all of the risks of participating in this class or activity, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I acknowledge that SSC is operating through the certifications they are allowed to operate through when writing plans and menu items, however, it is still my responsibility as a client to seek medical approval on any and all plans.

I acknowledge that signing this waiver operates indefinitely and retroactively. SSC is not liable for any injuries, mental health conflicts, emotional disturbances, or otherwise symptoms of participation. 

I acknowledge that SSC does not offer refunds of any kind. SSC will however on a case by case basis consider pausing or transferring programming (at the responsibility of the client).

I acknowledge that it is prohibited to copy or download SSC content, or share links to protected SSC content, like images and videos.

In consideration of my application and permitting me to participate in this class or activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this class or activity, the following entities or persons: SSC LLC and/or their directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers;

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in the paragraph above from any and all liabilities or claims made as a result of participation in this class or activity, whether caused by the negligence of release or otherwise.

I am completing this waiver and release of liability on behalf of myself OR as a legal guardian. 

I hereby consent to receive medical treatment that may be deemed advisable for myself or for my ward (if completing as a guardian) in the event of injury, accident, and/or illness during this activity. Including but not limited to AED, CPR, ice, etc. I consent to SSC making their best judgment call for my life and safety should I at any point become unconscious during a session and unable to speak for myself. 

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. This waiver extends to any and all locations in which I am engaging in activity or programming with SSC. 

I certify that I am 18 years old or more and have read this document and I fully understand its content. I am aware that this is a release of liability and a contract and I sign it of my own free will.
